A former trial attorney for the Marin County District Attorney's Office, for more than twenty years, Mr. McCarthy has defended cases involving medical and dental malpractice, construction defense, catastrophic personal injury, municipal entity liability, and product liability.

Mr. McCarthy has represented a wide variety of health care professionals, construction firms, developers, general contractors, and numerous subcontractors in all aspects of complex litigation.

In the field of professional liability, Mr. McCarthy has successfully defended health care professionals, hospitals, and emergency room personnel in malpractice cases arising from injuries including wrongful death, permanent brain injury, failure to diagnose cancer, surgical malpractice, and numerous other claims.

Mr. McCarthy has successfully obtained dismissals, for example, in cases involving the alleged wrongful death of a three-year old boy due to medical malpractice, and the severe closed head injury of a prisoner treated at a public hospital.

Mr. McCarthy has defended a wide variety of medical malpractice suits ranging from subdural hematoma/brain injury to wrongful death after extensive surgery, failure to diagnose cancer (malignant melanoma, ameloblastoma), discrimination against patients due to HIV positive status, negligent medical treatment involving delivery of babies, emergency room trauma treatment, and surgical team negligence. In such cases, Mr. McCarthy has represented physicians, surgeons, anesthesiologists, nurses, physical therapists, hospitals, and other health care providers.

Mr. McCarthy has handled malpractice claims on behalf of a wide variety of dental professionals. He has handled cases involving virtually every phase of dental treatment, incuding oral surgery, prosthodontics, periodontics, and orthodontics. Mr. McCarthy has handled cases arising from subacute bacterial endocarditis, squamous cell cancer, leukemia-related acute necrotizing ulcerative gingivitis, AIDS, and alleged discrimination based on HIV positive status.

Mr. McCarthy has also successfully handled numerous cases involving Administrative Law actions brought by the California Department of Consumer Affairs against health care providers.

Mr. McCarthy has served as a Hearing Officer for Delta Dental Plan of California's Medical Disciplinary Hearings.
